Karen Murphy had to pay nearly £8,000 in fines and costs for using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening.
But she took her case to the European Court of Justice.
The ECJ now says national laws which prohibit the import, sale or use of foreign decoder cards are contrary to the freedom to provide services.

A pub landlady has won the latest stage of her fight to air Premier League games using a foreign TV decoder, reports BBC News.
The European Court of Justice ruling could deal a major blow to the Premier League and its lucrative TV rights model. The BBC sports editor David Bond explains: "Unlikely though it might seem, the case all centres on a Portsmouth pub, the Red, White and Blue, and its landlady, Karen Murphy. She was fined back in 2006 for showing her customers live Premier League matches accessed via a Greek service and an illegal decoder."

The English Premier League (E.P.L) is responsible for selling F.A Premiership football match contracts to various sports broadcasters all around the world (especially in Europe) - Including to Sky UK. The broadcasters in-turn re-broadcast the games to their respective audiences (usually via satellite) charging viewers a fee for doing so.
Surprisingly, what many people don't realise is that it's possible to use any European broadcaster in order to receive football broadcasts here in the UK.
There are a number of sports broadcasters in Europe broadcasting high quality football coverage for a fraction of the cost of Sky TV. Our satellite TV systems simply receive football broadcasts from a number of European broadcasters utilising their official viewing card to allow access to channels.
It's effectively the same as a UK expatriate living in Spain receiving Sky TV (but in reverse).
Is it legal? Yes
! 100% legal
Because there is simply no law against it...! Regardless of protestations from Sky/MPS etc...! The fact is; The UK is a full EU member state and this effectively renders Europe as one single market Until or unless instructed otherwise (by a European court) all countries in the EU can receive each other's broadcasts and charge for services.
European law courts are due to look further at this matter and make a ruling (including non European broadcasters also) A final ruling is likely in the near future.
What about the Saturday 3pm live kick-off? There is currently a Union of European Football Associations (UEFA) ruling that stipulating that no UK broadcaster is permitted to show live F.A Premiership football matches on Saturday between 2:45 to 5:15pm (effectively one football match period).
This period is termed an F.A. 'closed-period' - The purpose being to protect gate receipts and match attendance at Premier league clubs.
There is no evidence to suggest the ruling applies to non-UK broadcasters - This is why UK broadcasters (i.e. Sky UK) are contractually forbidden to broadcast 3pm matches but non-UK broadcasters are permitted.

It is likely to be proved that because the broadcast originates from a non-UK source then it couldn't be subject to the ruling in any case. The European law court decision will provide guidance on this subject in due time.

Tring is a new player in the sports broadcasting game They have secured a three year contract with the English Premier League (2010 2013) - Tring currently broadcast Premiership, Champions League and F.A. cup matches... Live and in full English commentary..!
It is likely that Tring will secure the rights to more football competitions in the future.

So why haven't I heard of these systems before? Alternative solutions to receiving football coverage via satellite TV have been available for many years. Unfortunately Sky TV's Influence has always stifled their success with protestations that competition was illegal.
This has always created a cloud of uncertainty and confusion over their legality but publicans are becoming increasingly aware of Sky TV's cunning aspirations to maintain a stranglehold over UK Premiership football by any means.
It's now possible to receive football coverage from an increasing number of different broadcasters from all over Europe and the world - The advent of the internet is opening up a world of possibilities within a short period of time all sporting content will be delivered this way marking a revolution in the satellite TV and broadcasting industry...! |
